Lightglass terms of use
Last updated
The terms for using the Lightglass app and its in-app purchases.
Effective date: [to confirm with Dan: effective date]
These terms are an agreement between you and GLAD WE MADE IT LTD, trading as Blue Hour Atelier, a company registered in England and Wales (company no. 17322373), registered office Prime Apartments, 483 Green Lanes, London, N13 4FG, United Kingdom. “We”, “us” and “our” mean that company. “Lightglass” or “the app” means the Lightglass app for iPhone and iPad and everything inside it.
By downloading or using Lightglass you agree to these terms. If you do not agree, do not use the app.
Apple’s standard Licensed Application End User License Agreement also applies to the app. Where these terms say more than Apple’s agreement, these terms apply as well.
01Your license to use Lightglass
We give you a personal, non-exclusive, non-transferable, revocable license to install and use Lightglass on Apple devices that you own or control, through your Apple account, for your own personal, non-commercial use, under these terms and Apple’s App Store rules. We do not sell the app to you. We license it.
02Free artworks, Creative, Creative+ and bundles
- Free artworks. Seven artworks are free, with every feature of the app. They do not expire. We choose which artworks are free and may change the selection, but an artwork you have already painted for free stays yours to paint.
- Creative. A one-time purchase that unlocks every artwork in the library except those sold only in bundles. Creative may show a small number of ads. Painting is by tap.
- Creative+. A one-time purchase that unlocks the same artworks with no ads, plus Creative mode (paint with your own colors) and swipe painting.
- Upgrade. If you bought Creative, you can upgrade to Creative+ at the price shown in the app.
- Bundles. Extra sets of artworks, or sets of effects (lines, frames, lights), each sold as a one-time purchase. Bundles are separate from Creative and Creative+. From time to time we may give a bundle away inside the app.
- No subscriptions. Every purchase in Lightglass is one-time. Nothing renews and nothing is charged again.
- Family Sharing. Purchases can be shared with your family group through Apple’s Family Sharing. [to confirm with Dan: Family Sharing]
- What an unlock is. An unlock is the right to use that content inside Lightglass, on your Apple account, for as long as we offer the app. It is not a transfer of any ownership in the art.
03Payments, refunds and restoring purchases
- All purchases are made through Apple’s in-app purchase system and charged to your Apple account. Prices are shown in the app in your local currency and include any applicable taxes.
- Refunds are handled by Apple. We cannot issue refunds ourselves. To ask for a refund, go to reportaproblem.apple.com. Apple decides under its own rules.
- Restoring. If you reinstall the app or change device, open the Store in the app and tap “Restore purchases” while signed in with the same Apple account. Restoring is free.
- We may change prices for new purchases at any time. A price change does not affect something you already bought.
04What you may and may not do
You may:
- paint, save, export and share your finished artworks for personal, non-commercial use (for example on social media, as a wallpaper, or as a card to a friend)
You may not:
- copy, modify, resell, rent, lend, sublicense or redistribute the app, its art, its code or its text
- extract the artwork, verse library or other content from the app, by any means, for use outside the app
- sell prints or products made from Lightglass’s artwork, or present it as your own work
- reverse engineer, decompile or bypass the app’s purchase checks
- use the app in a way that breaks any law or infringes anyone’s rights
- use automated tools to interact with the app or our services
05Our content and your artworks
- Everything in Lightglass (the artwork, the paint-by-number designs, the app’s design, text, code, name and logo) is owned by GLAD WE MADE IT LTD or licensed to us, and is protected by copyright and other laws. Scripture quotations are from the World English Bible (WEB), which is in the public domain.
- When you finish an artwork you have made a colored copy of our artwork. We own the underlying artwork. You may use your finished image as described in section 4. We do not claim any ownership of photos or other material of your own that you combine with it outside the app.
- Blue Hour Atelier, Lightglass and the associated logos are trademarks or trading names of GLAD WE MADE IT LTD.
06Faith content
Lightglass presents scripture and devotional art. It is not a substitute for a church, a pastor, a counselor or a medical professional, and it does not give advice. We choose verses with care, but we are a small studio, not a religious authority.
07Reporting problems and feedback
If you send us a bug report, a suggestion or other feedback, you agree that we may use it to improve the app without owing you anything, and that you have the right to give it to us. See the privacy policy for what a bug report contains.
08Changes to the app and these terms
We may add, change or remove features and content. We will try not to remove content you have paid for; if we must, we will tell you in the app first. We may update these terms. When we do, we update the date at the top and, for material changes, tell you in the app. Continuing to use the app after a change means you accept the new terms.
09Ending the agreement
You can end this agreement at any time by deleting the app. We can end it if you break these terms. Sections 4, 5, 10, 11 and 13 survive the end of the agreement.
10Disclaimer of warranties
Lightglass is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranty that the app will be error-free, uninterrupted, or fit for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you.
11Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, arising from your use of the app. Our total liability to you for any claim related to the app is limited to the amount you paid us for the app in the twelve months before the claim.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you keep all the rights your local consumer law gives you.
12Apple’s role
These terms are between you and us, not Apple. Apple is not responsible for the app or its content. The following also applies, as Apple requires:
- Acknowledgement. Apple has no obligation to provide maintenance or support for the app.
- Scope of license. Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where we have enabled it.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.
- Intellectual property. If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
- Developer contact. GLAD WE MADE IT LTD, Prime Apartments, 483 Green Lanes, London, N13 4FG, United Kingdom, support@bluehouratelier.com.
- Third-party terms. You must comply with any third-party terms that apply when using the app (for example, the terms of a social network you share to).
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13Governing law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. [to confirm with Dan: governing law] If you are a consumer living elsewhere, you also keep the protection of the mandatory consumer laws of the country you live in, and you may bring a claim in your own country’s courts where that law allows.
If you have a problem, email us first. We would rather fix it than argue about it.
